Tilsen files motion to dismiss charges in PennCo Attorney’s Office case

PENNINGTON COUNTY, S.D. — A release from NDN Collective states that President & CEO Nick Tilsen has filed a motion to dismiss charges after what the motion describes as retaliation from the State Prosecutor.

The Motion to Dismiss is in reference to the case prosecuting Tilsen, citing him for misconduct and constitutional violations in actions he and other protestors took in the Black Hills in the lead-up to President Trump’s visit to Mt. Rushmore on July 3, 2020.
The motion comes in response to Pennington County Attorney’s Office recent statement indicating that it intends to prosecute Tilsen yet again, after initially stating it would move to dismiss these charges in exchange for Tilsen’s participation in a pre-trial diversion program.
NDN’s release states that prosecutors failed to contact him for three months, and that this latest announcement is a retaliatory response to Tilsen exercising his right to free speech.
