SD Supreme Court upholds decision on death row inmate
PIERRE, S.D. — After a series of appeals the South Dakota Supreme Court has upheld a previous courts’ decision to not allow death penalty inmate Briley Piper to challenge his guilty plea. The opinion filed Thursday comes after decades of on-going appeals.
Piper was sentenced to death for the killing of Chester Allen Poage in Lawrence County in 2000. His most recent appeal claims his 2001 plea was not voluntary or intelligent and his counsel assistance was ineffective.
Judge Randall Macy ruled Piper cannot challenge his plea and did not prove deficiencies or prejudice against those representing him.
