SD “Red Flag” law defeated by state legislators

PIERRE, S.D. — A bill that would allow guns and ammo to be seized from a person deemed mentally ill has been defeated by the Senate Judiciary Committee.

The sponsor of the bill, republican Art Rusch of Vermillion, believes the proposal provides for due process for those accused of being dangerous to others and themselves.

But the Judiciary Committee chair, Lance Russell of Hot Springs, says he’s concerned about false accusations.

Lieutenant Gov. Larry Rhoden, speaking for Gov. Noem, calls the bill a “Red Flag” law.
