Rosebud man sentenced for assault with a dangerous weapon

ROSEBUD S.D. — Lawrence Gary Jr. of Rosebud was sentenced for assault with a dangerous weapon on Monday. Gary was sentenced to 84 months in federal prison followed by three years of supervised release, and restitution may also be ordered.

The sentencing comes from an incident that occurred late at night on Jan. 20, 2018. Gary and the victim were both at a residence in the Two Strike community near Rosebud when the two eventually got into an argument. The argument ended with Gary assaulting the victim, striking him with his hands and fists until the victim fell to the floor.

Once on the ground, Gary continued the assault by striking the victim with a saucepan multiple times, and stabbing him in his back, between his shoulder blades, with a knife.

After the assault, Gary left the victim lying on the floor and left the residence.

The wound left the victim paralyzed from the neck down, as it severed his spinal cord. The victim was found lying on the floor the next day, and was transported to the Rosebud Indian Health Services Hospital before being transferred to Rapid City Regional Hospital. After receiving treatment, the victim was placed in a nursing home.

Gary was indicted on Feb. 14, 2018 and pleaded guilty on Aug. 7, 2018.

While Gary was awaiting sentencing, the victim passed away on Oct. 24, 2018. His death was found to be a result from the stab wound from the assault.
