Request for mistrial with prejudice denied in Allman murder trial
Prosecution intends to retry Barry Allman for the fatal stabbing of Lance Baumgarten in 2020.
RAPID CITY, S.D. — The Pennington County judge who had granted a mistrial for a man accused of second-degree murder in the August 2020 stabbing death of 33-year-old Lance Baumgarten has denied the defense’s request for a mistrial with prejudice, leaving the door open for a retrial.
Judge Matthew Brown denied the defense’s request, made on the behalf of 31-year-old Barry Allman of Box Elder. Allman is accused of fatally stabbing Baumgarten at an apartment on North 7th Street in Rapid City in the early morning hours of August 6, 2020.
