Box Elder woman charged in child death
BOX ELDER, S.D. — On Sunday, February 7, Box Elder Police and Volunteer Fire Department responded to a call at 240 N. Ellsworth Rd. for a child that was not breathing.
Law enforcement arrived on-scene and found a two year old unresponsive and beyond resuscitation. The responding officers reported bruising on the infant and called in additional investigators from Box Elder Police and the Pennington County Sheriff’s Office.
Monday, after reviewing available information and the completion of an autopsy, 22-year-old Precious Delaney Black Elk of Box Elder was taken into custody and charged with one count of second-degree Manslaughter and one count Abuse or Cruelty to a Minor Under Age Seven.
Manslaughter in the second degree is a class four felony and carries a maximum penalty of 10 years in prison and a $20,000.00 fine. Abuse or Cruelty to a Minor Under Age Seven is a class three felony and carries a maximum penalty of up to 15 years in prison and a $30,000.00 fine.
