A federal judge in South Dakota has thrown out an indictment against John Graham.
But, he is still facing state charges for his role in the murder of fellow American Indian movement activist, Annie Mae Aquash.
He's charged with aiding and abetting along with premeditated murder for Aquash's death back in 1975.
The trial for the other man charged in the case, Richard Marshall, is scheduled for later this month.
