The Meade County Commission is seeking legal action against the city of Sturgis.
Sturgis is working to annex land east of the city. But, the county says some of the steps taken by the city are not following proper statute.
The land in question is this area east of Sturgis. It includes Fort Meade, the high school, the Full Throttle, parts of Glenco Campground, and the Kickstart Gas Station.
The city has filed paper work to annex the land on Nov. 17 without the approval of the county commission.
Commissioners say they have a right in this process and have authorized the Meade County states attorney to seek legal action to stop the city moving forward.
Ken Chlevorad, the chief deputy states attorney in Meade County, says, "The city started an annexation process by filing petitions and so forth. Part of their petition contends the participation of the Meade County commissioners isn't necessary because of the status of some of the land involved. We disagree; we think the county commissioners are entitled to participate."
Sturgis Mayor Maury LaRue says, "We've been working to make sure we follow all the perimeter we are required to follow and a part of that is the recognition that the United States has supremacy over any South Dakota annexation statute."
The Sturgis mayor says the city is optimistic the annexation will go through without problems on Nov. 17.
